According to court documents filed in a Georgia Court, a Canada couple filed a lawsuit against a sperm bank after giving them sperm from a schizophrenic criminal.
The couple thought they were opting for a highly educated man with an impressive record of health when they selected a donor from the sperm bank to start their family.
Several years after the birth of their son, the couple of Port Hope, Ontario, learned that they were not told that their donor was a college dropout with a criminal record who suffers from schizophrenia.
Now, the couple is seeking damages for pain, suffering and financial losses against Xytex Corp., alleging that they engaged in fraud, misrepresentation, negligence and battery.
The two are not the only people affected by the donor. He has already fathered 36 children. Xytex however, denied that it failed to meet the highest standards for testing.
The couple chose their donor after being told that he is working on his PhD in Neuroscience Engineering, had a Masters in Artificial Intelligence and was mature beyond his age.
The couple was also told by Xytex, that they had done everything possible to ensure that the man was genuine and healthy.
The couple learned the truth about the donor after receiving a number of emails from Xytex with the donor’s name. After some research, they learned that the donor is schizophrenic, which is genetic and hereditary.
